“The FDA approved Viagra for use in this country in 1998 to treat erectile dysfunction, but the FDA did not approve it for use in the United States,” the defendants maintain. “Viagra is an effective treatment for erectile dysfunction that has been approved in the United States for the treatment of impotence. The FDA approved Viagra in 1998 for the treatment of ED and is not the only treatment approved for the treatment of ED.”
The defendants maintain that the FDA approval of Viagra is unlawful because it “has not been approved by the FDA in any other country for the treatment of ED.” The defendants argue that the FDA approval is unlawful because Pfizer’s marketing of Viagra in the United States is unlawful because it is a “new product” that is “an attempt to commercialize the drug and the drug’s benefits are not supported by the scientific evidence.”
